In the case of Abood v State of Queensland [2024] QSC 225, Haitham Abood, the plaintiff, filed proceedings against the State of Queensland and the Commonwealth of Australia. The case arose after an airport watchlist application filed by Abood too late resulted in his former partner leaving Australia with their infant daughter. Abood alleged negligence, malice, and ill will by the police and the Australian Federal Police (AFP). He claimed the authorities failed in their duties when they allowed his daughter’s departure, leading to what he described as her abduction. Ultimately, the Supreme Court struck out Abood's statement of claim for not disclosing a reasonable cause of action. The court recognized the unfortunate outcome for Abood but emphasized that not every unfair scenario justifies a legal remedy. The court noted the lack of substantiated legal grounds in Abood’s claims and dismissed them, ordering costs to be discussed separately.
