Attorney-General for the State of Queensland v Brown [2024] QSC 118

In Attorney-General for the State of Queensland v Brown [2024] QSC 118, the Supreme Court of Queensland addressed the issue of Troy Jimmy Charles Brown's repeated breaches of a supervision order under the Dangerous Prisoners (Sexual Offenders) Act 2003 (Qld) ("DPSOA"). The supervision order, initially made on 14 June 2021 and amended on 24 April 2023, prohibited the consumption of illicit drugs, including cannabis. Despite these prohibitions, Mr. Brown repeatedly ingested cannabis, resulting in multiple breaches. On 21 May 2024, the court, presided over by Davis J, ordered Mr. Brown's release from custody, emphasising that the supervision order had effectively reduced the risk of serious sexual reoffending and maintained adequate community protection.
