In Attorney-General for the State of Queensland v Christopher Robert Giddy [2024] QSC 56, the court addressed an application under the Dangerous Prisoners (Sexual Offenders) Act 2003 (Qld). The respondent, Christopher Robert Giddy, was previously detained under an interim detention order and was subject to a supervision order containing 37 requirements. The application was made following allegations that Giddy had contravened the supervision order, including committing an offence of assault occasioning bodily harm and breaching his curfew.
Despite these contraventions, psychiatric evidence indicated that Giddy's risk of reoffending was moderate to low if he continued under the supervision order. Based on this evidence, Justice Callaghan ordered that Giddy be released from custody on 11 March 2024 and remain subject to the supervision order.
