Attorney-General for the State of Queensland v Kennedy [2024] QSC 271

In the case of Attorney-General for the State of Queensland v Kennedy [2024] QSC 271, the Supreme Court of Queensland reviewed whether Neal Alfred Kennedy should remain under a continuing detention order. The court reaffirmed that Kennedy poses a serious danger to the community without such an order, under the Dangerous Prisoners (Sexual Offenders) Act 2003. Despite progress in addressing the respondent's issues, including psychological treatment and beginning antilibidinal medication, adequate protection under a supervision order was deemed unachievable at this time. The court noted Kennedy's ongoing need for significant support due to intellectual impairment and the inability to find suitable accommodation. Therefore, the order from December 2022 for continuing detention was upheld to ensure community safety.
