In Attorney-General for the State of Queensland v Kristopher Richard Joseph Moxham [2024] QSC 57, the Supreme Court of Queensland, under Justice Callaghan, reviewed the status of Kristopher Richard Joseph Moxham, a respondent subject to a supervision order made under the Dangerous Prisoners (Sexual Offenders) Act 2003. The original supervision order, imposed by Justice Cooper on 21 October 2022, was intended to last until 29 October 2027. However, Moxham breached the conditions of this order by obtaining a mobile phone and accessing social media. The Attorney-General applied for either a continuing detention order or an amendment to the supervision order. Upon reviewing expert evidence, including reports from psychiatrists Dr Michael Beech and Dr Josephine Sundin, the court concluded that a supervision order was sufficient to manage the risk posed by Moxham. Justice Callaghan ordered that Moxham be released from custody and that his supervision order be extended to 19 March 2029.
