Attorney-General for the State of Queensland v NYZ [2024] QSC 243

In the case of Attorney-General for the State of Queensland v NYZ [2024] QSC 243, the Supreme Court of Queensland ruled to detain the respondent, NYZ, indefinitely under section 13(5)(a) of the Dangerous Prisoners (Sexual Offenders) Act 2003. The Attorney-General sought this order, citing NYZ's significant history of sexual offenses and the high risk he posed to the community. Dr. Brown, Dr. Timmins, and Dr. Phillips provided psychiatric evaluations, agreeing on the high likelihood of recidivism if NYZ were released. The court emphasized NYZ's lack of rehabilitation and continued risk, thus prioritizing community safety. Despite recent minimal attempts by NYZ to engage in treatment, the overwhelming consensus was that community supervision could not mitigate his risk, warranting continued detention for his control, care, or treatment.
