Baigorri v Workers’ Compensation Regulator (No 2) [2024] ICQ 7

In Baigorri v Workers’ Compensation Regulator (No 2) [2024] ICQ 7, the Industrial Court of Queensland dealt with an appeal regarding workers' compensation. Horacio Augusto Baigorri contested the decision by the Workers' Compensation Regulator, challenging the rejection of his compensation claim originally upheld by both WorkCover and the Queensland Industrial Relations Commission (QIRC). The appeal was successful, leading to a dispute over the costs. The court concluded that while costs are generally awarded following the event, the appeal costs could not be awarded, limiting the compensation to those incurred during the hearing before the QIRC. Despite the Regulator's concession on general costs, there was contention over costs related to document disclosure. After reviewing the procedures and submissions, the court ordered the Regulator to cover Baigorri's costs amounting to $3,391.30 but made no order regarding the appeal costs.
