BN v LMN [2024] QDC 31

In the recent judgment BN v LMN [2024] QDC 31, the District Court of Queensland adjudicated on an appeal concerning a domestic violence protection order. The appellant, BN, sought to overturn a Magistrate's decision that had imposed a protection order for the benefit of LMN, the respondent. This order was initially put into place following instances of domestic violence, as identified under s 37 of the Domestic and Family Violence Protection Act 2012 (Qld). BN's appeal challenged the necessity and desirability of this order, alongside the Magistrate's reasoning. However, Judge Moynihan KC DCJ dismissed the appeal, confirming the original decision. The judgment underscored the discretion courts possess in issuing protection orders, reaffirming that such orders are crucial for safeguarding individuals from future domestic violence.
