IThe case of BYM v The Corporation of the Trustees of the Roman Catholic Archdiocese of Brisbane (No 1) [2023] QSC 298 centred on a civil claim for damages relating to personal injuries arising from alleged sexual abuse in 1999. The plaintiff, BYM, sought to keep identifying information confidential, invoking the Child Protection Act 1999 (Qld) to prevent the publication of their identity and that of CD, a witness in the trial. The trial court, led by Williams J, discussed the principles underpinning the publication of identifying information and the balance between open justice and individual protection. In its conclusion, the court vacated an initial non-publication order, replacing it with a more specific order that restricted the publication of identifying details about both the plaintiff and witness CD, subject to exceptions outlined in the Child Protection Act and other legal provisions.
