Byrnes v Jokona Pty Ltd [2002] FCA 41

In Byrnes v Jokona Pty Ltd [2002] FCA 41, the dispute involved a failed business venture concerning an indoor paintball centre in Liverpool, Sydney. The applicants, Mark Peter Byrnes and Brett Kevin Taprell, who were shareholders in the indoor paintball centre, brought claims against Jokona Pty Limited for breaches of lease and other related allegations, which they contended led to the failure of their business. These breaches included interruptions and interferences with the use of the demised premises and adjacent land, which were said to impede the operation of the business. The court found in favor of Byrnes and Taprell, awarding them $132,731 in damages, which accounted for interest and costs related to the proceedings. The cross-claim by Jokona Pty Limited for balance of rent and removal expenses was dismissed.
