In Desmond-Bryzak v Lander, the Supreme Court of Queensland granted an extension to the limitation period for the plaintiff, Harriett Desmond-Bryzak, allowing her to pursue an action against Dr. James Lewis Lander. This decision came after considering the plaintiff's pursuit for damages following pelvic mesh implant surgery performed by the defendant in November 2013. The court acknowledged the complexities surrounding the plaintiff’s delayed knowledge of the material facts concerning her right to action, which stemmed partly from her involvement in related class actions and medical consultations. Despite the defendant's objections, the court was satisfied that a fair trial could still occur, emphasising the importance of justice for the plaintiff’s well-founded claim for substantial damages. Consequently, the court ordered the extension of the limitation period to the date the proceeding was initially commenced in New South Wales, with specific instructions regarding the allocation of costs related to the application for this extension.
