In Eastlake v Capner [2024] QSC 136, the Supreme Court of Queensland ruled in favour of Teresa Jane Eastlake (plaintiff) against Shannon Leslie Capner (defendant) in a case involving false imprisonment. The Court ordered judgment for the plaintiff amounting to $364,203.72, which included general, aggravated, and exemplary damages for multiple incidents of domestic violence spanning several years. The damages awarded reflected the severity of the plaintiff’s mistreatment, which involved prolonged and repeated acts of violence and coercion by the defendant, her former de facto partner. Additionally, the Court determined interest on each of the relevant awards at a rate of four percent, starting from the day after each incident up to the present. The defendant did not appear in court nor filed a defence response, resulting in a default judgment. The judgment also included an order for the defendant to pay the plaintiff’s legal costs on a standard basis.
