Floyd v Nevgold Pty Ltd t/as Trustee for The Brian Jorgensen Family Trust (No 2) [2024] QDC 106

In Floyd v Nevgold Pty Ltd [2024] QDC 106, the District Court of Queensland addressed a costs application following the plaintiff's unsuccessful bid for summary judgment. Malcolm Lewis Floyd filed for commission as a real estate agent for the sale of several properties by the defendant, Nevgold Pty Ltd. The court ruled that the issue of the plaintiff being the effective cause of the sale necessitated a trial, rejecting the summary judgment. The court denied Nevgold’s application for costs, determining that each party should bear its own costs for the summary judgment application.
