In Harrison v Anderson [2024] QCAT 152, the Queensland Civil and Administrative Tribunal (QCAT), presided over by Member J M Aberdeen (Acting Magistrate), addressed a neighbourhood dispute concerning a dividing fence between the properties at 3 and 5 Lochmaben Court, Beaconsfield. The applicant, Rodger Dennis Harrison, sought the removal of a dilapidated timber fence and its replacement with a new one, claiming the existing structure was irreparable. In contrast, the respondent, Miranda Anderson, while acknowledging the need for partial maintenance, contested the complete replacement due to financial constraints, offering to contribute to what she could afford. After examining evidence, including quotes for repair and replacement, and the condition of the fence through photographic submissions and a personal inspection, Aberdeen concluded the existing fence was still functioning as a "sufficient dividing fence" and therefore dismissed the application for its complete replacement.
