Harvey v State of Queensland (Queensland Health) [2024] ICQ 10

In Harvey v State of Queensland (Queensland Health) [2024] ICQ 10, the Industrial Court of Queensland, led by Davis J, dismissed the appeal of Alistair John Harvey, a senior security officer who had been terminated from his role at Prince Charles Hospital. Harvey had struck a patient with his baton, claiming the patient was violent and posed a threat, leading to his dismissal for breaching conduct codes. Harvey's appeal contested the reasonable grounds of his actions and the fairness of his dismissal. However, the court found no error in the original findings that justified Harvey's dismissal, emphasising the expectation for security officers to pursue de-escalation before resorting to physical measures.
