HEG v Queensland Police Service & UHB [2024] QDC 134

In HEG v Queensland Police Service & UHB [2024] QDC 134, the District Court of Queensland dealt with an appeal from the appellant, HEG, against a protection order made by a Magistrate in the Emerald Magistrates Court. The appellant challenged the findings of domestic violence incidents, specifically the incidents on 10 January and 12 March 2023, which had prompted the issuance of a Police Protection Notice. HEG contended that the Magistrate erred in finding that domestic violence occurred and criticized the credibility of the second respondent, UHB. The court found that the evidence supported the Magistrate's conclusions, particularly noting that the appellant's actions during the incidents were consistent with the statutory definition of domestic violence under the Domestic and Family Violence Protection Act 2012 (Qld). Ultimately, the appeal was dismissed, with the court affirming that sufficient reasons were provided for the original decision, highlighting the necessity and desirability of the protection order for UHB’s safety.
