In HL v HR [2024] QDC 126, the District Court of Queensland addressed an application from the defendant, HR, seeking to set aside a default judgment entered against him on March 23, 2023. The plaintiff, HL, alleged a series of sexual abuses spanning from 1980 to 1992. The proceedings faced delays, partly due to HR's health issues, including strokes and suspected Parkinson’s disease, and ongoing related criminal charges. The court found that HR did provide a satisfactory explanation for his failure to defend and demonstrated a viable defense on the merits. Ultimately, the court granted HR leave to file an amended application, requiring him to pay $25,000 towards HL's costs within 14 days, while also dismissing the request for a stay of the proceedings. The case was ordered to remain in the District Court for final determination.
