Horsburgh and Anor v Valuer-General [2024] QLC 11

Horsburgh and Anor v Valuer-General [2024] QLC 11 concerns an appeal by Ailsa Margaret Haig Horsburgh and John Richard Horsburgh against an annual property valuation made by the Valuer-General. The primary legal issue was whether the Land Court of Queensland had jurisdiction to hear the appeal given that it was filed after the designated appeal period. The appellants argued that there was a reasonable excuse for the delay, primarily due to Mr Horsburgh's unexpected and urgent medical condition—a Level 4 melanoma diagnosis requiring immediate surgery. Despite the late filing, the Court found that the appellants' medical circumstances constituted a reasonable excuse under section 158 of the Land Valuation Act 2010. Consequently, the Court determined it had jurisdiction to hear and decide the appeal.
