In the case of Diane Marie Smith, the Supreme Court of Queensland, presided over by Justice Muir, addressed her application for bail amidst a series of charges, including drug offenses, robbery, and breaches of bail conditions. Despite the Crown opposing bail due to the risk of reoffending and failure to appear, Justice Muir found sufficient reason to grant bail with strict conditions. Smith, who has a history of drug-related crimes and previous breaches, was on remand for six months, using the time to address her addictions and devise a future plan. Bail conditions included residing with her mother under specific restrictions like curfew and no-contact orders, in addition to a mental health treatment plan, which aimed to mitigate risks associated with her release.
