This was Mr. Tosovic's fourth bail application, previously denied due to concerns of him posing an unacceptable risk—either of committing further offenses or interfering with witnesses, particularly impacting his former wife. The Court presided over by Justice Muir required a material change in circumstances to reconsider bail. The recording of the complainant's evidence was deemed a significant change that reduced witness interference risk. However, despite acknowledging the time Tosovic had spent in custody, which might exceed the potential sentence for minor charges, Justice Muir maintained that the risk of harm to the complainant outweighed the reasons to grant bail. The application was ultimately dismissed due to concerns for the complainant's safety if Tosovic were released.
