In the matter of an application for bail by Kyle Robert Whalley [2024] QSC 239

In the matter of Kyle Robert Whalley's bail application, the Supreme Court of Queensland, presided over by Justice Muir, granted bail under specific conditions. Whalley, aged 25, faced multiple charges including serious drug trafficking and weapons supply offenses. The court considered the risks of him failing to appear in court or committing further offenses if released on bail, balanced against his community ties, lack of criminal history, and supportive family network. The proposed bail conditions, which include residential restrictions, regular reporting, travel prohibitions, communication monitoring, and compulsory drug rehabilitation and mental health assessments, were deemed sufficient to mitigate these risks. Consequently, Justice Muir determined that the conditions adequately reduced any potential risks, allowing Whalley to be granted bail.
