In the matter of AZZ [2023] QSC 299

In the Supreme Court of Queensland case In the matter of AZZ [2023] QSC 299 concerning the applicant AZZ, the court refused the applicant's request to start criminal proceedings against his ex-wife, the respondent. AZZ sought to present private criminal charges for multiple offenses including perjury and fraud, under s 686 of the Criminal Code 1899 (Qld). The application was dismissed due to the potential abuse of judicial process, given an existing protective order - pursuant to the Domestic and Family Violence Protection Act 2012 (Qld) - against AZZ, and concerns that the proceedings might be used to bypass this order. Justice Williams, taking into account public interest and the gravity of the allegations, determined that criminal proceedings should be pursued through state authorities or within current family law proceedings, instead of through a private prosecution.
