In In the Will of Hans-Juergen Meyer [2024] QSC 141, the Supreme Court of Queensland considered an application by Noeline Margaret Fairless and Carmen Bernadette Van Niekerk, the executors nominated in a testamentary document provided by the deceased. Hans-Juergen Meyer, who died from pancreatic cancer on 11 June 2023, left behind a will dated 6 June 2023, consisting of four typed pages and one handwritten page. The will was prepared under extraordinary circumstances, guided by his solicitor, Mr Bow, and not witnessed due to Meyer's deteriorating condition. The court had to decide whether to dispense with the requirement for witnesses as outlined in the Succession Act 1981 (Qld). Judge Kelly J found that Meyer intended the document to serve as his will, meeting the criteria of section 18 of the Act. As a result, the will was admitted to probate, and a minor correction was made to clarify the orders regarding the true copy of the will.
