In Laurie Lindner Constructions Pty Ltd v Western Cape Communities Trust Pty Ltd [2024] QSC 123, Laurie Lindner Constructions (LLC), the respondent plaintiff, contracted with WCCT to construct a new administration centre in Weipa. LLC claims that while the project costs exceeded $13.4 million, it received only $8.9 million in payments from WCCT, prompting it to sue WCCT for over $4 million due to alleged underpayments and unjust enrichment. Given LLC's financial difficulties, which it attributes to WCCT’s conduct, WCCT applied for security for its costs. The court, led by Henry J, found that LLC's impecuniosity was partially attributable to WCCT's actions, compelling an order that LLC provide security for $90,000 for WCCT’s costs up to the mediation stage. The ruling further stipulated that the proceeding would be stayed until such security is provided, with liberty granted to WCCT to apply for further security if needed.
