In LSA v State of Queensland [2024] QSC 102, the plaintiff, LSA, brought claims against the State of Queensland regarding alleged unlawful actions by Queensland Police Service (QPS) officers. LSA argued that he was falsely imprisoned during interactions with the QPS and that these officers acted unlawfully in their investigations. He also claimed that the officers were part of a conspiracy with his former partner, who he alleged was a covert police officer involved in attempts to harm him.
The court found that all of LSA's claims were without merit. Justice Cooper determined that the QPS officers had acted lawfully in their interactions with LSA and in issuing the police protection notices. The evidence did not support LSA's allegations of a conspiracy or unlawful conduct by the officers. Justice Cooper dismissed the plaintiff’s claims, concluding that LSA had failed to prove that he was falsely imprisoned or that the actions of the QPS officers amounted to misfeasance in public office, abuse of process, malicious prosecution, or negligence.
