In MacMines Austasia Pty Ltd v Chief Executive, Department of Environment, Science and Innovation [2024] QLC 16, the Queensland Land Court considered an appeal from MacMines regarding the rejection of its Environmental Authority (EA) application for the China Stone Coal Project. The court found that the application was not "properly made" under the Environmental Protection Act 1994 due to deficiencies in the information provided, specifically regarding the assessment of environmentally relevant activities, including the likely environmental impacts and compliance with statutory conditions. Although the review decision pertaining to certain lapses was set aside, the court upheld that the application failed to meet the compliance requirements set forth in sections 125(1)(l) and 126A of the Act.
