In Maggs & Pasitkunlapat v Commissioner of Police [2024] QDC 102, the District Court of Queensland dismissed the appeal lodged by the appellants Mr Paul Mathew Maggs and Ms Kanpachira Pasitkunlapat. The appellants were convicted in the Magistrate Court at Southport of assault occasioning bodily harm in company, stemming from an altercation captured on CCTV. Both appellants contested their convictions, arguing the findings were unreasonable and against the weight of evidence. They also claimed the Magistrate made errors in fact and law. The District Court, led by Judge Prskalo KC, confirmed the Magistrate's findings, determining that the evidence, including CCTV footage, substantiated the convictions beyond a reasonable doubt. The appeals were dismissed and no orders as to costs were made.
