In McIntosh v Commissioner of Police [2024] QDC 142, the District Court of Queensland heard Joshua Peter McIntosh's appeal against a magistrate's sentencing decision concerning fraud charges. McIntosh, having pled guilty, initially received 12 months imprisonment for each of the nine offenses of fraud in the Brisbane Magistrates Court. On appeal, Judge Smith AM DCJA allowed the appeal, setting aside the original decision. Considering McIntosh's extensive time served in custody—totaling over three years linked with similar offenses in both Queensland and New South Wales—the court issued an adjusted sentence of 8 months imprisonment for each count, to be served concurrently, and immediately suspended for a 12-month operational period.
