In the legal case Miller v WorkCover Queensland [2024] QDC 156, the District Court of Queensland presided over a civil trial where Lisa Miller, the plaintiff, sought damages due to alleged personal injury suffered in the workplace, resulting in PTSD, which she claimed occurred after an altercation with her estranged husband, Darren Starling, at Wet Fix Pty Ltd. WorkCover Queensland, the defendant, challenged her status as a worker under the Workers’ Compensation and Rehabilitation Act 2003 and disputed her claims of assault and the resulting PTSD. The court found inconsistencies and fabrications in Miller's evidence, including misleading photograph submissions and altered statements, contributing to a lack of credibility in her testimony. Consequently, the court dismissed Miller’s claims, determining she failed to establish being a worker under the act, that an assault occurred, or that the incident led to psychiatric injury. The court also denied her application to reopen the case and directed both parties to submit costs considerations.
