In the case of Montesin v Brisbane City Council [2023] QIRC 068, Darren Montesin, the applicant, sought to have his case removed from public records or, at the very least, his name removed from search engines such as Google to protect his safety and that of his family. Montesin's concerns stemmed from past assaults and threats he faced during his employment with Brisbane City Council as a bus driver. The Queensland Industrial Relations Commission (QIRC), however, dismissed the application. The QIRC highlighted its lack of jurisdiction to either remove the case from public records or direct non-parties like Google to take specific actions regarding online content. Additionally, the commission found Montesin's application for modifying the decision by de-identifying his name as unfounded due to insufficient evidence of the alleged safety risk.
