In Orr v Director of Proceedings on Behalf of the Health Ombudsman [No 2] [2024] QCA 106, the appellant, Andrew Jamie Orr, was ordered to pay the respondent's costs of the appeal. The appeal arose from earlier disciplinary proceedings handled by the Queensland Civil and Administrative Tribunal (QCAT). The appellant argued for each party to bear their own costs on various grounds, including alleged unlawful conduct and the resolution of a novel point of law of public importance. The Court of Appeal determined that there were no exceptional circumstances to deviate from the usual order that costs should follow the event, as stipulated in the Uniform Civil Procedure Rules 1999. Consequently, the Court of Appeal ordered the appellant to pay the respondent’s costs.
