In the case of Paetzold v At Beach Court Holiday Villas Pty Ltd [2024] QCA 227, the Supreme Court of Queensland dealt with an appeal involving Herman Herbert Paetzold, who filed for leave to appeal a District Court decision. Paetzold, serving as a caretaker, sustained an injury to his Achilles tendon due to allegedly negligent conditions involving a mower with a flat battery. While the primary court found negligence causing the Achilles injury, it ruled against Paetzold's claim relating to a knee injury, attributing it to degenerative conditions rather than the incident. The trial judge also found Paetzold's credibility compromised due to his failure to report income to Centrelink while receiving the age pension, a concern not properly addressed until litigation prompted tax return filings in 2021. The Court of Appeal, agreeing with the lower court's findings, highlighted no errors in judgment that warranted overturning the decision, thus refusing the leave to appeal and dismissing the cross-appeal.
