In the legal case of Paladin Projects Pty Ltd v Visie Three Pty Ltd & Ors (No 2) [2024] QSC 244, the Supreme Court of Queensland considered a dispute regarding costs arising from the adjudication under the Building Industry Fairness (Security of Payment) Act 2014. The applicant, Paladin Projects Pty Ltd, contested elements of an adjudication decision which were found to be void due to jurisdictional error. However, the primary contention in this case was over costs following a Calderbank offer made by the first respondent, Visie Three Pty Ltd, which the applicant refused. The court examined whether the rejection of this offer was unreasonable, eventually ruling that it justified the imposition of indemnity costs. Williams J ordered Paladin Projects to pay standard costs up to the date of the Calderbank offer and indemnity costs thereafter.
