In the case of Peacock v State of Queensland [2024] QDC 179, the plaintiff, Jodi Irene Peacock, claimed damages against her employer, the State of Queensland, for alleged negligence that led to an injury during a firearms assessment. Employed as a custodial corrections officer, Ms. Peacock argued that she aggravated a pre-existing spinal degenerative condition due to inadequate instructions to warm up prior to a reactionary gap test. The court found that the employer was not negligent as the risk was not foreseeable, considering her physical fitness and lack of prior disclosed back pain issues. The court discovered that her reported ongoing pain was linked to her pre-existing condition, which had resolved by 2021. Consequently, judgment was awarded in favour of the defendant, and no damages were granted to Ms. Peacock.
