In Platform Constructions Pty Ltd v Fourth Dimension AU Pty Ltd ATF BD Hope Unit Trust & Ors [2024] QSC 235, the Supreme Court of Queensland dealt with an application from Platform Constructions seeking declarations regarding two adjudication decisions. The central issue was the validity of decisions made under the Building Industry Fairness (Security of Payment) Act 2017 (Qld). The court declared the first decision void as the adjudicator was not registered at the time of making the decision, necessitating its removal from public records. However, the court refused to declare the second decision void, finding that the applicant failed to demonstrate non-compliance with statutory requirements by the adjudicator. Consequently, no declaration was issued regarding the second adjudication decision. Costs issues remain pending further court submissions.
