In the case of Podium Project Marketing Pty Ltd v B Global (Aust) Pty Ltd [2024] QDC 3, the Brisbane District Court handled an interlocutory application concerning a contractual dispute between Podium Project Marketing Pty Ltd, the plaintiff, and B Global (Aust) Pty Ltd, the defendant. The case revolved around whether Podium, acting as a property agent for B Global, was entitled to commissions for property lot sales it claimed were facilitated by unlicensed salespersons employed by entities Freedom and Alliancecorp. Although Podium argued these sales qualified them for commission under existing agreements, the court deliberated whether section 89 of the Property Occupations Act 2014, which restricts commission recovery to licensed agents, applied since the salespersons lacked licenses. Judge Byrne KC DCJ ultimately refused Podium's application for summary judgment, maintaining that the plaintiff had prospects of failure in supporting its claim that it was the effective cause of sales, thereby denying any entitlements to the commission.
