Purcell v Indigenous Land and Sea Corporation & Anor [2024] QSC 58

Nathan Patrick Purcell sought an extension on the period of limitation for personal injury resulting from a workplace incident in 2013, arguing new decisive facts had come to light. Representing himself against the Indigenous Land and Sea Corporation and Primary Partners Pty Ltd, Purcell's application hinged on the Limitations of Actions Act 1974 (Qld) due to the delay in filing common law proceedings. The case highlighted Purcell's extensive medical history and his delayed recognition of the injury's long-term impact, leading to the application for an extension. Notably, Purcell was unaware of the significant, permanent impairment until obtaining specialized legal and medical advice. On April 12, 2024, Justice Crow ruled in Purcell's favour, allowing the extension based on the discovery of material facts of a decisive nature and ordered the respondents to pay Purcell's application costs.
