R v BZW [2024] QSC 260

In the Supreme Court of Queensland case R v BZW [2024] QSC 260, the accused, BZW, was charged with four counts: burglary by breaking in the night in company, with a circumstance of aggravation for being armed (count 1), murder (count 2), malicious act with intent (count 3), and assault occasioning bodily harm in company (count 4). The trial was conducted without a jury, and Justice Copley presided over the proceedings. BZW was found guilty on count 1 for burglary, although not guilty of the armed circumstance of aggravation. For count 2, BZW was acquitted of both murder and the alternative charge of manslaughter, while for count 3, BZW was acquitted of malicious act with intent and the alternative charge of unlawful wounding. For count 4, however, BZW was found guilty of assault occasioning bodily harm in company. The case involved issues relating to common intention and whether BZW had knowledge of a weapon in his co-accused’s possession, which ultimately influenced the verdicts rendered for each count.
