R v DCF [2024] QCA 181

In the Supreme Court of Queensland case R v DCF [2024] QCA 181, the appellant, DCF, appealed against his conviction which involved taking a child under 12 for immoral purposes and two counts of indecent treatment of a child under 16. The central issues in his appeal were the reliability of the complainant's identification of the appellant and whether the trial judge misdirected the jury on this point. The evidence included video recordings of the complainant and photographic evidence relating to the appellant's injured left arm. Despite the appellant’s efforts to argue that inconsistencies in the complainant's identification especially relating to the appellant's arm versus visual evidence about his arm should have led to a miscarriage of justice, the Court of Appeal upheld the conviction. Additionally, a direction concerning the appellant's alleged sexual interest in the complainant was warranted under the precedent set by Bauer, given the circumstances of the offenses. The appeal was ultimately dismissed.
