The incident occurred in 2004 during a party in Pomona, where Demmery, then aged 27, assaulted the victim in his utility vehicle while she was asleep. Originally sentenced to two years in prison, to be suspended after serving six months, Demmery's appeal was successful, leading to a reduction in his sentence. The Court of Appeal, acknowledging his lack of previous convictions, employment record, and significant remorse, altered the sentence to a suspension after the 25 days already served, with a 12-month operational period.
