R v Kostandy [2024] QCA 190

In the case of R v Kostandy [2024] QCA 190, the appellant, Maged Sobhy Naguib Kostandy, sought to appeal against both his conviction and sentence after being found guilty of five counts of fraud. The case was heard in the Court of Appeal with Judges Mullins P, Dalton JA, and Williams J presiding. Kostandy argued that his conviction was unreasonable, citing issues with the prosecutor's conduct, claims that his defense counsel was incompetent, and alleging trial misdirection. He contended that the evidence presented was flawed and inconsistencies existed in the testimonies of key witnesses. Furthermore, Kostandy claimed that his defense of an honest claim of right was not duly considered. The court dismissed his appeal, finding no merit in the assertions regarding misconduct by his legal representation or the prosecutor.
