In R v LBF [2024] QCA 129, the Queensland Court of Appeal dismissed the appellant’s appeal against convictions for maintaining a sexual relationship with a child and indecent treatment of a child under 16. The appellant was found not guilty of four counts of rape and one count of choking in a domestic setting. The appellant argued that the guilty verdicts were inconsistent with the not guilty verdicts because they relied on the same evidence from the complainant. The Court found that a reasonable jury could have logically reached the different verdicts, given the specific details and circumstances of each charge. The evidence presented reasonable doubt regarding consent for the rape and choking counts but was sufficient to support convictions for maintaining a sexual relationship and indecent treatment. Accordingly, the appeal was dismissed.
