R v Mason [2024] QCA 104

In R v Mason [2024] QCA 104, James Morton Mason (the appellant) appealed against his conviction for murder following a trial in which he had pleaded guilty to arson. The central issue was the appellant's intention when he set fire to a car under the home of the deceased, who perished in the fire. The appellant contended that a miscarriage of justice occurred due to inadequate explanation of the defence case by the trial judge, particularly in relation to the anticipated consequences of lighting the fire. The Court of Appeal dismissed the appeal, ruling that the trial judge had correctly summarised the defence's position and that the jury had been adequately instructed. The evidence demonstrated that the appellant knew the house would likely catch fire but argued he did not foresee the deceased’s death. Consequently, the appeal was dismissed, upholding the conviction.
