R v Mogg [2024] QCA 125

In R v Mogg [2024] QCA 125, the Court of Appeal of Queensland reviewed an appeal regarding the sentence of Raymond Joseph Mogg, who was convicted of two counts of sexual assault, one count of attempted rape, and one count of deprivation of liberty. The District Court had sentenced Mogg to varying terms of imprisonment, most notably seven years for the attempted rape, which the applicant deemed manifestly excessive. Despite the applicant's legal counsel advocating for a lower sentencing range of four to five years for the attempted rape, the Court of Appeal determined the original sentence to be appropriate given the gravity and circumstances of the offence. The appeal was dismissed, affirming that the seven-year imprisonment was a suitable exercise of the Court's sentencing discretion, considering the nature of the crime and the limited mitigating factors presented.
