R v Rogan [2021] QCA 269

In the case of R v Rogan [2021] QCA 269, Peter Rogan was initially sentenced to 12 months of imprisonment, to be suspended after serving two months, for indecently assaulting a complainant during a party. Rogan, who had also been ordered to pay $2,000 compensation to the victim, appealed the sentence as manifestly excessive. The Supreme Court of Queensland granted the appeal, highlighting Rogan's lack of criminal history, his employment background, stable relationships, remorse, and the uncharacteristic nature of the act. The court emphasised the need to balance general deterrence and the severity of the crime against the potential benefits of rehabilitation for individuals unlikely to reoffend. Ultimately, the court suspended the term of imprisonment.
