In R v Seymour & Ors [2024] QDC 93, the District Court of Queensland ruled on a stay application for an indictment involving defendants Daniel Seymour, John Doumani, and Christopher John Pappas. The case, which primarily revolved around numerous counts of fraud, including some with aggravating circumstances, had a complex procedural history stretching over eight years. The initial charges against the defendants were dismissed in 2018 due to deficiencies in the prosecution's case particulars but were later recharged. Despite the Crown's attempts to address these deficiencies, the particulars were deemed persistently inadequate. Judge Jackson KC, DCJ, decided that the substantial delay, coupled with the prosecution's repeated failure to provide adequate particulars, created an atmosphere of oppression. Therefore, the Court ordered that the indictment 455/2023 be permanently stayed.
