R v Volkov [2024] QCA 87

In R v Volkov, Vadim Victor Volkov, who had pleaded guilty to trafficking in dangerous drugs, sought an extension of time to file an application for leave to appeal against his nine-year sentence. The original sentence, imposed on 24 June 2021, did not include a parole recommendation. The Court of Appeal had previously rejected Volkov's application for leave to appeal against the sentence on the merits, and the High Court also dismissed an application for an extension to seek special leave to appeal. Mullins P, Bond JA, and Crow J of the Supreme Court of Queensland issued several orders: they granted leave to tender certain documents but dismissed the application to adduce further evidence beyond that. Ultimately, they refused the application for an extension of time to file an appeal, citing that the proposed grounds either reiterated or merely refined arguments already addressed in the original hearing.
