The case of R v WXZ [2024] QSC 216 involved a defendant who assumed the role of stepmother to two children and was sentenced for manslaughter and cruelty to a child. WXZ pleaded guilty to unlawfully killing ZYV, a child with Down Syndrome, through gross neglect and failing to provide adequate care, which led to severe malnourishment and the child's death. Additionally, WXZ admitted to cruelty towards another child, BZX, who survived with serious injuries. Despite the severe nature of the offenses, mitigating circumstances such as WXZ's impaired cognitive functions, history of abuse, and displayed remorse influenced the sentencing. The court sentenced WXZ to 9 and a half years for manslaughter and 2 years for cruelty, with sentences to run concurrently. With a credit for time served, WXZ is eligible for parole on 3 June 2026, after serving 6 years in actual custody. Convictions were recorded and no further punishment was given for a summary charge of cannabis possession.
