Re Bennie [2024] QSC 223

In the case of Re Bennie [2024] QSC 223, the Supreme Court of Queensland considered an application by Jordan Edward Allan Bennie for letters of administration on the intestate estate of his aunt, Diana Rosalind Bennie. Diana passed away without a will on June 18, 2023, leaving no spouse or children. Her siblings, John Bennie and Myriam Whitting, renounced their right to administer the estate, making Jordan, her nephew, the next eligible relative. Although the deceased's grandparents and any other relatives were presumed deceased or non-existent, no other interested parties came forward following a public notice. The court, exercising its discretion under the Uniform Civil Procedure Rules, granted administration on intestacy to Jordan Bennie, and ordered that the costs of the application be covered by the estate.
