Richards v Hutchinson [2024] QSC 73

In the case of Richards v Hutchinson [2024] QSC 73, the Supreme Court of Queensland resolved to dismiss Ms. Richards' amended application for an extension of the limitation period for her annexure C defamation claim, effectively barring her from proceeding with this part of her claim due to it being initiated outside the designated time frame as per the Limitation of Actions Act 1974 (Qld). This decision underscored the stringent nature of statutory limitation periods in defamation actions and emphasized the requirement for claimants to adhere to these timelines to seek redress. Additionally, the Court granted summary judgment against Ms. Richards for various segments of her claim, including her allegations of defamation and civil conspiracy, against the majority of the defendants on the basis that she had no real prospect of success.
